Update on Johnson property
The Johnson’s or any property owner who has land in Chapter 61A has to renew their property every year with the Assessors Department. They may have to do this with the state as well.
In 2014 the Johnson’s renewed all their Chapter 61A property with the Assessors except for the property identified as Map & Parcel 72-3 (shown above) located on Chestnut Hill Road.
If the Johnson’s have a sale within 12 months of taking the property out of Chapter 61A they are required to notify the town which would trigger the Town’s right of first refusal.
However, the Johnson’s did not have a sale within the first 12 months so this did not trigger the right of first refusal.
Per the developer there is a binding agreement in place. I do not know the details of this agreement.
The property is identified in the Open Space plan as a priority site for protection. I am not sure what outreach or efforts were made by the OSPC, SOLF or Trustees of Reservation to preserve this property in the past.
The Developer has now been before the Planning Board, SHOPC and the department heads informally with a conceptual plan. Nothing formal has been submitted. The developers stated that they are doing their due diligence at this time. I believe their next stop is with OSPC and then they plan on returning to the Planning Board on November 5th at 8:15pm.
